Bonus: Sample Response
The Burqa is a traditional external garment worn by women in some Arabic and Middle Eastern countries. There seems to be an argument that this garment is derived from the prevalent religion in those countries, but, to Western eyes, it is perceived as an overt expression of the oppression of women. The arguments from both sides appear to undermine people’s freedom and capacity to make their own choices.
The arguments on both sides can appear circular: on the one hand, the fact that the Burqa covers the entire face gives rise to the suspicion of there being a threat from those wearing it, possible criminality and a grudging acknowledgement that possibly those wearing the Burqa may be in need of some kind of liberation from invisibility.
On the other hand, the arguments against banning can appear condescending: poor oppressed creatures with no agency of their own, coerced and imprisoned by their men folk, who need the intervention of Western minds to free them from their subjugation.
The Constitution, however, contains provisions relating to freedom of religious expression. The question, therefore, is this: is the Burqa an expression of the religion of those wearing it? Would a ban of the Burqa be a breach of those parts of the Constitution relating to freedom of religious expression or other implied freedoms?
Although not all relevant countries acknowledge that the Burqa is required by the prevalent religion of their particular state, some sects of those prevalent religions do consider it required, just as some, but not all, Christian sects consider an overt sign of their religion required.
In the end I think it boils down to this: no one knows what specific family situations are, so we have to accept that some women choose to wear the Burqa. Banning the Burqa removes choice and may well be experienced by them as equally as oppressive as requiring it.
